Commercial Litigation

  • Attorneys Rebein and Reinert Mahieu represented an area bank in a security interest priority dispute over the ownership of cattle in a feedyard offered as collateral to three different banks and the feedyard itself.

  • Attorneys Rebein and Reinert Mahieu represented a high school senior and gifted athlete whose vehicle was struck by a cattle hauler with a full load. The hauler was cited for running a red light and no valid commercial driver’s license. He had previous, multiple state convictions.

Complex Commercial Litigation

  • Rebein represented a cattle feeder against a consortium of banks that seized his herd when the banks foreclosed on the feedyard holding his cattle. 
    Result: Cattle feeder recovered most of his investment, the U.S. Attorney lawyer prosecuted the feedlot owner, resulting in his imprisonment

  • Rebein represented a group of ranchers against the Sierra Club and others wanting to build a recreation trail through their ranch properties on the site of an abandoned railroad. 
    Result: Permit request denied

Construction Litigation

  • Rebein and Reinert Mahieu represented a construction company in a dispute with an owner over whether work it did for the owner was correcting work it had previously done or whether the work was extra work required by the fault of someone other than the construction company. 
    Result: Settlement

Financing Transactions

  • Kite assisted a cattle feeding company with a $9 million private placement of limited liability company interests in a cattle-feeding enterprise. 

  • Kite assisted a private university in the negotiation of a Series A Preferred investment and joint venture arrangement with a biotech company developing genetic cancer and AIDS vaccines.

  • Kite represented a real estate developer in a transaction involving the restructure of a limited partnership holding approximately $5 million in undeveloped real estate, the issuance of approximately $2.5 million in limited partnership interests, and the refinancing of approximately $5 million in real estate-backed indebtedness.

  • Kite represented a stockholder in a closely-held Southwest Kansas construction company in the $500,000 sale of the stockholder's stock in the business.

  • Rebein and Kite are assisting a Dodge City business owner with complex zoning and liability matters for an expanded sports and recreational facility.

Mergers and Acquisitions

  • Kite represented a privately-held railroad company and its owners in a $90-million sale (via stock sale and merger) of two subsidiary companies holding 14 independent short-line railroads to a publicly-traded railroad company.

  • Kite represented a privately-held farm and construction implement distributor in a $1.2 million cash-for-assets acquisition of a privately-held implement dealership.

Oil and Gas Class Action

  • Rebein is one of a group of lawyers representing most of the nation's natural gas pipeline owners in a gas mismeasurement class action case. Rebein was selected to argue on behalf of the Defendants against, among others, David Boise. Boise was vice-president Al Gore's attorney in the Florida ballot challenges and was also involved in the Microsoft antitrust case.

Personal Injury

  • Attorneys Rebein, Bangerter and Reinert Mahieu represented a teenage client and his family in a personal injury and wrongful death suit. The teen was driving to school for an early morning practice when his car was hit by a pickup driver who was cited for running a stop sign. The teen's passenger-father later died.

  • Rebein represented a lineman injured after falling off of a 50-foot pole during a storm. The employee underwent a multi-level spine fusion and returned to work, where the company ordered him to end his career behind a desk. 
    Result: The court agreed that the employee with medical clearance was entitled to return to his line position, allowing the employee to end his career on his own terms

  • Rebein and Reinert Mahieu are representing a man whose neck was broken and whose rib cage was crushed when the vehicle he was riding in was struck head-on by a recreational vehicle (RV) illegally passing on a hill.

  • Rebein and Reinert Mahieu are representing the family of a woman seriously injured by a pharmacy that made a prescription error.

  • Rebein and Reinert Mahieu are representing a husband and wife who were nearly killed by a drunk driver.

  • Rebein represented a rancher accused of accidentally starting a fire that burned 30,000 acres on the High Plains.

Worker Compensation 

  • Rebein appealed a fraudulent worker compensation award before the Kansas Supreme Court. 
    Excel Corp. v. Goertz,
    Result: Lower court ruling in favor of Rebein's client was upheld

  • Rebein argued a retaliatory discharge case for an area co-operative before the Kansas Court of Appeals that helped establish state legal precedent. 
    Griffin v. Dodge City,
    Result: Court upheld lower court ruling in favor of Rebein's client

  • Bangerter argued a case before the Kansas Supreme Court on whether or not a dairy should be excluded from the Workers Compensation Act as an agricultural pursuit. 
    Rivera v. Cimarron Dairy, Result: Client won

  • Bangerter argued a case before the Kansas Supreme Court that made new state law regarding whether or not damage to a prosthetic device constituted a new injury under the workers compensation act. 
    Solis v. Brookover Ranch Feedyard, Inc., Result: Client won

  • Bangerter argued before the Kansas Court of Appeals case on whether or not a work disability should be granted and how overtime compensation should be considered.
    Hernandez v. Monfort Inc., Result: Client won

  • Bangerter argued before the Kansas Court of Appeals on whether or not a work disability should be granted when the employee was terminated for falsification of his employment application.
    Ramirez v. Excel Corp., Result: Client won

  • Bangerter argued before the Kansas Court of Appeals on determining the appropriate date of an accident in a repetitive trauma injury.
    Alberty v. Excel Corp., Result: Client won

  • Rebein represented the family of a young mother, who was fatally injured when a trailer came unhooked from a semi-truck and struck her vehicle.
